1. Petitioners seek quashing of FIR No.196/2018 under Sections 308/34 at Police Station Shakar Pur.
2. The parties are related to each other and also belong to the same village. Subject FIR was registered consequent to a quarrel that took place between the parties with regard to selling of fruits on a hand cart. It is alleged that complainant vends fruits etc. from a handcart and the petitioners/accused had also brought their handcart and started selling fruits next to the complainant on account of which an altercation took place. 2018:DHC:4506 CRL.M.C. 3310/2018
3. Learned counsels for the parties submit that the parties have settled their disputes with the intervention of friends and other respectable persons of the village and compromise deed dated 11.05.2018 has been executed.
4. Complainants are present in court in person and identified by the Investigating Officer. They submit that they have settled the dispute with the petitioners and do not wish to press the complaint against them any further. Both parties assure that they shall maintain cordial relations and shall not quarrel with each other.
5. In view of the fact that the disputes between the petitioners and complainants have been settled and they do not want to prosecute the complaint any further, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
6. In view of the above, the petition is allowed. FIR No.196/2018 under Sections 308/34 at Police Station Shakar Pur and the consequent proceedings emanating therefrom are, accordingly quashed.
