1. Petitioner seeks quashing of FIR No.226/2013 under Sections 354- A/354-D/419/506/507 IPC at Police Station Greater Kailash.
2. The parties are known to each other and were friends. Subsequently, it is contended that on account of a misunderstanding the parties fell out and subject FIR was registered consequent to a quarrel that took place between the parties. It is alleged that petitioner thereafter attempted to defame the respondent.
3. Parties were referred to mediation. They have settled their disputes through the process of mediation and settlement agreement dated 2018:DHC:5266 CRL.M.C. 3118/2018 28.08.2017 has been executed at the Mediation Centre, Saket Courts, New Delhi.
4. Respondent No.2 present in court in person is identified by the Investigating Officer. She submits that she has settled the disputes with the petitioner and does not wish to prosecute the complaint any further.
5. In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
6. In view of the above, the petition is allowed. FIR No.226/2013 under Sections 354-A/354-D/419/506/507 IPC at Police Station Greater Kailash and the consequent proceedings emanating therefrom are, accordingly quashed, subject to the payment of cost of Rs.15,000/- to be deposited by the petitioner in the Chief Minister Disaster Relief Fund of the State of Kerala within a period of two weeks from today.
