Allowed, subject to all just exceptions.
1. The petitioner seeks quashing of FIR No. 254 of 2015 under Sections 354-A/506/509 of the IPC registered at Police Station 2018:DHC:4629 Mansrovar Park, Delhi, based on a settlement.
2. The charge sheet has only been filed under Section 354-A of the IPC. The parties were referred to mediation and parties have settled before Delhi Mediation Centre on 22.01.2018.
3. The petitioner who is present in person in Court has apologized to respondent no. 2 and she has accepted the apology. He assures that he shall not repeat his conduct in future.
4. Respondent no. 2 is present in court in person, represented by her counsel and is identified by the Investigating Officer. Respondent no. 2 submits that she has settled the disputes with the petitioner and is agreeable to the settlement and does not wish to press the criminal charges against the petitioner any further.
5. In view of the fact that the disputes between the petitioner and respondent no. 2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
6. In view of the above, the petition is allowed. FIR No. 254 of 2015 under Sections 354-A/506/509 of the IPC registered at Police Station Mansrovar Park, Delhi, subject to payment of cost in the sum of Rs. 10,000/- to be paid by the petitioner with the Delhi High Court Bar Association Advocates Welfare Trust, within a period of two weeks. The receipt of deposit of costs imposed by this order be furnished to the concerned I.O. within a period of three weeks from today.
