JUDGMENT
1. The present Application has been filed seeking restoration of the present Petition which was disposed of on 27.07.2018.
2. In view of the order that this Court proposes to pass today, the present Application is allowed. The Petition is restored.
3. The Application stands disposed of.
4. Learned Counsel for the parties submit that the parties have amicably resolved their disputes and in pursuance thereof, a banker’s cheque in the sum of Rs. 7,00,000/- has been handed over by the learned Counsel for the Respondent to the learned Counsel for the Petitioner today who acknowledges the receipt. 4.[1] Learned Counsel for the Petitioner undertakes that the cheque shall be honoured on presentation.
5. A copy of the same has also been handed across to the Court today. The Registry is directed to scan and upload the same so that it remains embedded in the case file.
6. Learned Counsel appearing on behalf of the Petitioner submits that since the matter between the parties stands settled, nothing survives for further adjudication in the matter.
7. Accordingly, and in view of the settlement, learned Counsel for the Petitioner seeks and is granted liberty of the Court to withdraw the present Petition.
8. Subject to the realisation of the aforesaid amount, the Petition stands disposed of as settled, the parties are directed to abide by the terms of the Settlement. All pending Applications stand closed.
