JUDGMENT

1. The petitioner seeks interim bail in case FIR No. 18/2014 under Sections 21-C/29/61/85 of the NDPS Act read with Sections 419/468/471/474 of the IPC, Police Station Special Cell, New Delhi.
2. The ground taken by the petitioner is that the petitioner intends to dispose of some agricultural land situated at District Faridpur, Bareilly U.P. for the purpose of making financial arrangements for his family.
3. Status report has been filed which verifies the fact that the petitioner 2018:DHC:4739 BAIL APPLN. 1232/2018 has agreed to sell 3 bighas of land and the prospective purchaser has already given an advance at the time of sale agreement and remaining payment is to be made at the time of execution of documents.
4. Learned Addl. PP opposes the application by submitting that earlier also the petitioner had obtained interim bail on similar ground, however, no such sale document were executed. She further submits that the petitioner is involved in five similar cases out of which three cases are still pending.
5. In view of the fact that petitioner has already finalised the deal and only sale documents have to be executed and payment received, I am of the view that the petitioner can be taken in custody for the purpose of executing the sale document.
6. Accordingly, it is directed that at the time when the petitioner has to execute sale document, the jail authorities shall make necessary arrangements for taking the petitioner to the office of the concerned Tehsildar/Sub-Registrar for the purpose of executing sale documents in police custody.
7. The petition is accordingly disposed of in the above terms.
8. Order Dasti under signatures of the Court Master. Order be communicated to the Jail Superintendent also.
