1. The office report indicates that the respondents have been served. However, none appears for the respondents.
2. The petitioner, by the present petition, seeks a direction to the trial court to adjudicate the complaint of the petitioner under Section 138 of the Negotiable Instruments Act, expeditiously. 2018:DHC:4994 CRL.M.C. 2959/2018
3. Learned counsel for the petitioner submits that the complaint was filed as far back as in the year 2014 and on 01.04.208 when the petition was listed before the trial court there was an abstinence call from the Bar Association and accordingly petitioner could not be present in court and the matter was adjourned to 15.01.2019 with the service report ‘premises unlocked’. Thereafter no further direction was issued for summoning the accused but the matter was simpliciter adjourned for complainant presence.
4. Keeping in view the facts and the circumstances of the case and the fact that despite service, respondents have chosen not to appear before this Court, the trial court is accordingly directed to expedite the proceedings and conclude the same within a period of 9 months from today.
5. List the matter before the trial court for direction on 30.08.2018.
6. Petition is disposed of in the above terms.
