JUDGMENT
09.08.2018 SANJEEV SACHDEVA, J. (ORAL)

1. The petitioner seeks bail in FIR No. 84 of 2018 under Sections 308 of the IPC Police Station Prasad Nagar. Petitioner has been in custody since 22.06.2018. The parties are neighbours living in the same neighbouring colonies.

2. Subject FIR was registered consequent to a quarrel that took place between the parties. It is contended that the parties are known to each other and have settled their disputes.

3. The complainant of the FIR is present. He consents that he has settled with the petitioner and settlement agreement dated 17.05.2018 has been 2018:DHC:4988 BAIL APPLN. 1571/2018 Page 2 executed. He submits that they both have known each other for the last 8 to 10 years and on account of a misunderstanding, the subject dispute occurred.

4. Keeping in view the fact that parties have settled the dispute and complainant is present, I am of the view that the petitioner has been able to make out a case for grant of regular bail.

5. Accordingly, on petitioner furnishing a bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Trial Court. Petitioner shall be released on bail, if not required in any other case. The petitioner shall not do anything, which may prejudice either the investigation or the prosecution witnesses.

6. Petition is disposed of in the above terms.
