SIDDHARTH MRIDUL, J (ORAL)

1. The present writ petition under Article 226 of the Constitution of India prays as follows:- 2018:DHC:5003-DB “a) Alternatively issue a writ of mandamus and direct the respondent No.3 to grant approval to the faculty list submitted by petitioner under clause 7(13) of NCTE Regulations, 2014 expeditiously to enable the respondent No.2 to grant formal recognition; and b) Issue a writ of mandamus and direct the Chairperson, of respondent No.1 to exercise its powers under clause 12 of NCTE Regulations, 2014 to relax/waive the condition of obtaining approval of faculty list from respondent No.3 as prescribed under clause 7(13), (15) & (16) and consequently direct respondent No.2 to grant formal recognition to petitioner under clause 7(16) for D.El.Ed. course on the basis of un-approved faculty list prepared by petitioner; and c) Pass any other and further order(s) as may be ` deemed fit.”

3. Ms. Arunima Dwivedi, learned Standing Counsel accepts notice on behalf of the respondents.

Mr. Sanjay Sharawat, learned counsel appearing on behalf of the petitioner, limits the relief in the present petition, to a direction to the respondent No.3, State Council of Education Research & Training (SCERT), to grant approval to the faculty list prepared by them, under Clause 7(16) for D.EL.ED Course, for the academic session 2018-19, expeditiously and preferably within a period of two days from today.

Learned counsel appearing on behalf of SCERT states that they would do the needful, in accordance with law, after examining the faculty list, provided by the petitioner, within a period of ten working days from today, provided an authorized representative of the petitioner appears in their office on 14.08.2018 at 11.30 a.m. along with all the supporting documents.

6. Ordered accordingly.

7. With the above directions, the writ petition is disposed of.

8. A copy of this order be given dasti under the signature of Court Master to counsel for the parties.
