02.08.2018 The petitioners seek anticipatory bail in FIR No.238/2014, P.S. Prasad
Nagar registered under sections 308/324/34 IPG which is pending for the last four years. The other persons mentioned in the FIR as accused i.e. Smt. Geeta and Smt. Saroj have been granted anticipatory bail.
It is contended that (i) in any case, the petitioners have been wrongly implicated inthe case; (ii) the weapon ofoffence has not yet been recovered;
(iii) there is hardly any progress in the investigation; (iv) the case is nowhere near filing ofthe Charge-sheet inthe Court; and (v) the petitioners are a law abiding citizen and are ready and willing to join investigation as and when called for.
In the circumstances, acase is made out by the petitioners for grant of interim protection and it is directed that in the event of arrest of their in FIR
2018:DHC:8234 H No. 238/2014 under Sections 308/324/34 IPC registered at Police Station
Prasad Nagar, they be released on bail on their furnishing a personal bond in the sum of Rs.25,,000/- with a surety in the like amount each to the satisfaction of the Arresting/Investigating Officer, subject to the following conditions:
(i) the petitioners will join investigation before the lO on 02.08.2018 at 4 pm and he shall continue to participate in the investigation as and whenthey are so intimated by the Investigating Officer;
(ii) they shall make no attempt, directly or indirectly, to contact the complainant or her relatives or close associates;
(iii) their contact number shall be operational at all times, so that the police could contact him;
(iv) they shall not make any effort to evade the process oflaw; and
(v) in case of change of the phone numbers or address, the petitioners shall inform the police forthwith.
Observation made inthis order shall have no bearing on the merits of the case.
The petitions are disposed off.
A copy ofthis order be given dasti to the learned counsel appearing onbehalfoftheparties under thesignature oftheCourt Master.
