CRL.M.C. 3795/2018 & Crl.M.C.3787/2018

1. Petitioners in Crl.M.C.3795/2018 seek quashing of FIR No.251/2018 under Sections 451/341/323/506/509/34 IPC at Police Station Kirti Nagar and petitioner in Crl.M.C.3787/2018 seek quashing of FIR No.248/2018 under Sections 325 IPC Police Station Kirti Nagar.

2. The parties are related to each other being neighbours. FIRs are cross FIRs. They were registered consequent to a quarrel that took place between the parties on parking of vehicles.

3. Learned counsels for the parties submit that the parties have settled their disputes with the intervention of other family members as well as members of the locality. Memorandum of Understanding dated 20.07.2018 has been executed. Parties assure that they shall maintain cordial relations and peace and harmony in the locality.

4. Respective complainants are present in court in person, represented through their counsel and identified by the Investigating Officer. They submit that they have settled their dispute with the petitioners and do not wish to press the complaint against them any further.

5. In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

6. In view of the above, the petition is allowed. FIR No.251/2018 under Sections 451/341/323/506/509/34 IPC at Police Station Kirti Nagar and FIR No.248/2018 under Sections 325 IPC Police Station Kirti Nagar and the consequent proceedings emanating therefrom are, accordingly quashed.

7. Order Dasti under signatures of the Court Master.
