SIDDHARTH MRIDUL, J (ORAL)

1. The present petition under Article 226 of the Constitution of India prays as follows:- “(a) issue a writ, order or direction or an appropriate writ to direct the respondent to temporarily de-seal the property in khasra bearing No.96, Ground Floor, Satbari Village, New Delhi to enable the petitioners to take out the article, equipment, fitting & fixture from the said property.” 2018:DHC:5045-DB W.P.(C)8326/2018

2. Issue notice.

3. Ms. Arunima Dwivedi, learned counsel accepts notice on behalf of the respondent.

4. Learned counsel appearing on behalf of the petitioners limits the relief in the present petition to a direction to the SDMC to consider his application seeking permission to remove his goods and belongings from the subject premises situated at khasra No.96, Ground Floor, Satbari Village, New Delhi, that are lying sealed.

5. Having heard learned counsel appearing on behalf of the parties, the SDMC is directed to disposed of the representation filed on behalf of the petitioners in this behalf, in accordance with law, within two weeks from today, under intimation to the petitioners.

6. With the above direction, the writ petition is disposed of accordingly.

7. A copy of this order be given dasti to the learned counsel appearing on behalf of the parties under signature of the Court Master.
