JUDGMENT
1. The petitioner had applied for recruitment to the post of Constable (GD) in the Central Armed Police Forces[1]. His candidature has been rejected vide PST Rejection Slip dated 25 August 2025 on the ground that he was not of the requisite height.
2. We may note that the required height for recruitment as Constable (GD) is 170 cms whereas according to the PST Rejection slip, the petitioner height was 169.[3] cms, which is just 0.[7] cms short of the requisite height. “CAPF”, hereinafter
3. The petitioner has placed reliance on a certificate issued by the District Government Hospital, Kuchaman City, Rajasthan, which has certified his height to be 171 cms.
4. Ordinarily, with respect to any medical requirement, if there are concurrent findings by two Medical Boards of the Respondent, this Court does not interfere merely because an outside Medical Board has given a favourable finding.
5. In the present case, however, the petitioner has been subjected to height testing only once. Mr. Puneet Yadav, learned counsel for the respondent, points out that only as per the Notification under which the petitioner has applied and the PST Rejection Sip itself, the petitioner had a right to appeal to the Appellate Authority, which he could have exhausted.
6. We find that the right is merely chimerical in nature as the petitioner is required to appeal to the Appellate Authority on the same day. We fail to understand that why even 24 hours has not been granted to the candidates to appeal against the rejection.
7. As the issue in question is only regarding the height of the petitioner, we deem it appropriate to dispose of this writ petition with a direction to the Appellate Authority of the respondents to measure the height of the petitioner and examine whether he makes the cut-off of 170 cms.
8. We record the undertaking of the petitioner that he would abide by the finding of the Appellate Authority.
9. Let the petitioner’s height be measured by the concerned Appellate Authority on 23 September 2025.
10. The decision would be communicated to the petitioner forthwith.
11. The writ petition is allowed to the aforesaid extent.
12. A copy of this order be provided to learned counsel for the parties under the signatures of the Court Master.
