1. Status report has been filed. Previous conviction/involvement report of petitioner no.1 has been filed. Same is taken on record. As per the report, there is no record of the petitioner no.1 having been involved in any other case.
2. The petitioners seek quashing of FIR No.1015/2014 under Sections 509/506/34 IPC and section 12 of the POCSO Act, 2012, Police Station Uttam Nagar. 2018:DHC:5809
3. Parties are neighbours.
4. Subject FIR was registered consequent to a complaint made by respondent no.2 that petitioners were misbehaving with her daughter.
5. Learned counsel for the petitioners submits that the parties have settled their disputes.
6. The petitioners who are present in person in Court have apologized to respondent no. 2 for their conduct and have assured that they shall not misbehave with the respondent No.2.
7. The respondent Nos.[2] & 3 are present in Court in person and are identified by the Investigating Officer. They submit that they have settled their disputes with the petitioners and do not wish to prosecute the complaint any further and have no objection to the quashing of the subject FIR.
8. In view of the fact that the parties have resolved their disputes and respondent No. 2 & 3 do not wish to press their complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
9. In view of the above, the petition is allowed. FIR No.1015/2014 under Sections 509/506/34 IPC and section 12 of the POCSO Act, 2012, Police Station Uttam Nagar and the consequent proceedings emanating there from are quashed.
10. Order Dasti under the signatures of the Court Master.
