SIDDHARTH MRIDUL, J (ORAL)

1. The present petition under Section 11 of the Contempt of Courts Act, 1971 prays as follows:- 2018:DHC:5917-DB “a) Initiate the contempt of court proceedings against the following contemnors for deliberate and wilful disobedience of the order dated 17.04.2018 in W.P.(C) 4271 of 2017 passed by this Hon’ble Court:-

1. Sh. Rakesh Kumar Agarwal (SDG), the Engineer in Chief...Contemnor No.1

2. Sh. Puneet Goyal, SDMC Commissioner...Contemnor No.2

3. Sh. Ranbir Singh, EDMC Commissioner...Contemnor No.3

4. Sh. Taj Hassan, Spl. Commissioner of Police, Traffic...Contemnor No.4 b) Pass any such or similar order/orders as deemed fit and proper in the facts and circumstances of the present case.”

The petitioner, by way of the present petition, seeks initiation of contempt against the officials of Municipal Corporation of Delhi, Public Works Department and Delhi Traffic Police on the assertion that despite directions of this Court issued on 17.04.2018 in W.P.(C) 4271/2017, titled as ‘Sunil Kumar vs. Lt.Governor of State of NCT Delhi & Ors.’, they have failed to install Flexible Height Barriers and man them, as well as, install two CCTVs with 360 degree view/desktop/monitors for live monitoring of the subject area.

Mr. Gautam Narayan, learned Additional Standing Counsel appearing on behalf of Government of NCT of Delhi states that they have already placed two Flexible Height Barriers at the subject area and shall man them round-the-clock to ensure that unauthorized truck traffic is not permitted to ply in the area.

5. Mr. Gaurang Kanth, learned Standing Counsel appearing on behalf of East Delhi Municipal Corporation says that they shall ensure installation of two CCTVs with 360 degree view/desktop/monitors for live monitoring of the subject area, within two weeks from today.

6. Directed accordingly.

7. No further directions are called for in the present petition.

8. With the above directions, the petition is disposed of.
