16.10.2018 The petitioners have prayed for quashing of the FIR No.916/2014 under Sections 498-A/406/34 IPC, registered at PS Geeta Colony on the ground that settlement had been arrived at between the Ajay Kumar
(petitioner No.1 in Crl.M.C.3174/2018) and respondent No.2 Sonia.
2018:DHC:8267 It is submitted that petitioner Ajay Kumar and respondent No.2 Sonia have settled their dispute vide memorandum of settlement dated
17"^ November, 2015. Other petitioners are relatives of the petitioner Ajay
Kumar. Marriage between Ajay Kumar and Sonia has been dissolved by a decree of divorce dated 3'"'' October, 2016, passed by Family Court, East
District, Vishwas Nagar, Delhi.
Respondent No.2 Sonia has appeared along with her counsel and is identified by the SI M.S.Gautam, PS Geeta.
^ Respondent No.2 submits that she has settled the matter with the petitioners of her own free will and without any undue force, pressure or coercion and has no objection in case FIR No. 916/2014 under Sections 498-
A/406/34 IPG, registered at Police Station Geeta Colony is quashed against the petitioners.
Keeping in mind the settlement arrived at between the Ajay Kumar
(petitioner No.l in Crl.M.C.3174/2018) and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petitions are disposed of in the above terms.
