1. Petitioner seeks interim bail for a period of six weeks on the ground that the mother of the petitioner, who has undergone surgery, requires postoperative attention from her family members.

2. It is contended that there is no family member who is in a position to take care of the mother of the petitioner.

3. Learned counsel for the petitioner submits that petitioner was granted interim bail for three weeks by the Trial Court by order dated 28.09.2018 for the purposes of attending to the mother of the petitioner for the purposes of the surgery. After the surgery was performed, petitioner 2018:DHC:6849 BAIL APPLN. 2488/2018 duly surrendered in terms of the orders of the court.

4. Medical record has been verified. It has been confirmed that the mother of the petitioner underwent a surgery on 15.10.2018. As per the medical record she has been advised post-operative care of three weeks.

5. Learned APP submits that there are other male member available in the family of the petitioner to take care of the mother of the petitioner.

6. It is not in dispute that the mother of the petitioner requires care and attention. She is a female and there are only three male members in the family which may not be conducive for taking care of a female patient.

7. Keeping in view the facts and circumstances of the case and also the fact that the petitioner was earlier released on interim bail and is not alleged to have violated any of the conditions of the bail, I am inclined to grant interim bail to the petitioner for a period of 10 days from the date of her release. Accordingly, on furnishing bail bond in the sum of Rs. 50,000/with one surety of the like amount, petitioner shall be released on bail. Petitioner shall duly surrender after the expiry of 10 days of her release. Petitioner shall not contact the child victim and she shall not do anything which may prejudice the trial or the prosecution witnesses.

8. Petition is disposed of in the above terms.
