1. The petitioner seeks a direction to the trial court to expedite the disposal of the complaint case filed by the petitioner.

2. Learned counsel for the respondents submits that insofar as the prayer for expeditious disposal is concerned, he has no objection to the same, however, he denies the factual averments made in the petition and submits that parties are already in arbitration and further, as per the respondent no case is made out and he reserves his right to 2018:DHC:6418 CRL.M.C. 3941/2018 take appropriate steps inter alia for quashing of the subject complaint.

3. In view of the above, the trial court is directed to expedite the disposal of the complaint and endeavour to dispose of the same preferably within a period of six months. List the matter before the trial court, on 23rd October, 2018, for fixing a schedule for expeditious disposal.

4. It is clarified that this order shall be without prejudice to the rights and contentions of the parties before the Arbitral Tribunal and also shall be without prejudice to the right, if any, of the respondents to seek quashing of the subject complaint. It is further clarified that this court has neither considered nor opined on the merits of the case of the either parties.

5. The petition is disposed of with the above directions.

6. Order dasti under the signatures of the Court Master.
