JUDGMENT
1. Petitioner seeks quashing of case FIR No. 446/2014 of Police Station New Usmanpur, North East Delhi for offence under Section 279/337 IPC on the ground that the victim/complainant de facto (respondent no. 2) has compromised the dispute with him.
2. Broadly speaking, the petitioner, while driving his truck in rash and negligent manner collided the same against the TSR being driven by respondent no. 2, thereby causing minor injuries to the latter by way of a jerk. Consequently, on complaint of respondent no. 2 the FIR under CRL.M.C. 4646/2025 pages consideration was registered.
3. Learned APP accepts notice and submits that State has no serious objection to this petition.
4. Respondent no. 2 identified by IO/SI Suresh Kumar Meena and accompanied with his counsel accepts notice.
5. I have spoken with respondent no. 2 in Hindi and he states that since only some minor injuries by way of a jerk were suffered by him in the roadside accident, he has compromised the dispute with petitioner and now he does not wish to pursue prosecution of the petitioner.
6. Having spoken with respondent no. 2/victim, I am satisfied that it would be in the interest of justice not to push the parties through trial.
7. Therefore, the petition is allowed and FIR No. 446/2014 of Police Station New Usmanpur, North East Delhi for offence under Section 279/337 IPC and proceedings arising out of the same are quashed. Pending application stands disposed of.
