JUDGMENT

1. Allowed, subject to just exceptions. O.M.P.(MISC.)(COMM.) 340/2018

2. Issue notice.

3. Ms. Tannya Sharma accepts notice on behalf of the respondent.

4. Learned counsel for the respondent says that she does not wish to file a reply as she does not oppose the prayer made in the petition for extension of time for concluding the arbitration proceedings.

5. The record shows that an Arbitrator was appointed by this Court, vide order dated 18.10.2016, passed in Arb. P. 248/2016.

6. The learned Arbitrator entered upon reference on 15.11.2016. Since the statutory period of 12 months was coming to an end, parties mutually agreed for extension of time on 14.11.2017. 2018:DHC:7247

7. It appears that the arbitration proceedings could not be concluded, and therefore, an application was made to this Court for extension of time on 21.05.2018. This Court granted a further 6 months for conclusion of arbitration proceedings.

8. The extension as granted by this Court is coming to an end today i.e. 14.11.2018.

9. I am informed by counsel for the parties that the matter is at the stage of arguments.

10. Having regard to the time and money invested by the parties in the arbitration proceedings, I am inclined to grant further extension of 4 months for conclusion of arbitration proceedings.

11. The period of 4 months will commence from today i.e. 14.11.2018.

12. The petition is disposed of in the aforesaid terms.
