JUDGMENT

1. By this transfer petition, the petitioner seeks transfer of Suit No.57/2018, titled as “Rayban Insulation Private Limited vs. Teral – Aerotech Fans Private Limited”, pending in the Court of Mr.Mohit Sharma, Civil Judge, South West, Dwarka, Delhi, to the Court of Mr.Devender Nain, ADJ, Shahdara District, Karkardooma Courts, Delhi, wherein the connected suit with regard to the same transaction between the parties i.e. Suit No.968/2017, titled as “Teral – Aerotech Fans Pvt. Ltd. vs. Rayban Insulation Pvt. Ltd.”, is pending disposal for 22.01.2019.

2. The learned counsel for the respondent, on instructions, states that the respondent has no objection. Admittedly with respect to the 2018:DHC:7779 TR.P (C) 103/2018 same transaction, the respondent has filed the above said suit later in time.

3. In the circumstances, Suit No.57/2018, titled as “Rayban Insulation Private Limited vs. Teral – Aerotech Fans Private Limited”, pending in the Court of Mr.Mohit Sharma, Civil Judge, South West, Dwarka, Delhi, is withdrawn and the same is transferred to the Court of Mr.Devender Nain, ADJ, Shahdara District, Karkardooma Courts, Delhi, for disposal in accordance with law.

4. Parties are directed to appear before the transferee Court on 16.01.2019.

5. The petition along with application, being C.M. No.23097/2018, is disposed of accordingly.
