JUDGMENT

1. By this transfer petition, the petitioner seeks transfer of Suit No.53/2007 (New No.CS DJ/614742/2016), titled as “Master Ankur Chopra vs. Shri Yogesh Tanjea”, pending in the Court of Mr.Sanjeev Kumar, ADJ-12, Central District, Tis Hazari Courts, Delhi, to the court of Ms.Priya Mahendra, ADJ-4, South District, Saket Courts, New Delhi, where the suit filed by the respondent/plaintiff for possession in respect of the same property is pending.

2. The learned counsel for the respondent, on instructions, states that the respondent has no objection if the suit pending in the Court of Mr.Sanjeev Kumar, ADJ-12, Central District, Tis Hazari Courts, 2018:DHC:7634 Tr.P. (C.) 192/2018 Delhi, is transferred to the court of Ms.Priya Mahendra, ADJ-4, South District, Saket Courts, New Delhi.

3. In the circumstances, the above said suit, being Suit No.53/2007 (New No.CS DJ/614742/2016), titled as “Master Ankur Chopra vs. Shri Yogesh Tanjea”, pending in the Court of Mr.Sanjeev Kumar, ADJ-12, Central District, Tis Hazari Courts, Delhi, is ordered to be withdrawn and transferred to the Court of Ms.Priya Mahendra, ADJ-4, South District, Saket Courts, New Delhi for disposal in accordance with law.

4. Parties are directed to appear before the transferee Court on 12.12.2018.

5. The petition along with application, being C.M. No.42384/2018, is disposed of accordingly.
