(ORAL)

1. Petitioner seeks quashing of case FIR No. 47/2019 of PS Civil Lines for offence under Section 376 IPC read with Section 6 POCSO Act on the ground that the complainant de facto (respondent no.2) has compromised the disputes with the petitioner.

2. Respondent no.2 appearing with her counsel and identified by IO/Inspector Gurdeep Kaur accepts notice. Learned APP accepts notice and submits that State has no serious objection to this petition.

3. It appears that respondent no.2 then aged about 17 years 10 months was engaged in a love affair with the petitioner and developed sexual intimacy followed by her pregnancy by the time she attained the age of majority. When taken to the hospital in the course of pregnancy, the hospital authorities reported the matter to the local police which led to registration of the subject FIR.

4. I have spoken with both parties in Hindi and it is stated by them that now they are living happily as a family and have two children. Respondent no.2 specifically submits that she does not wish to pursue prosecution of petitioner.

5. Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push the parties through trial. Therefore, the petition is allowed and FIR No. 47/2019 of PS Civil Lines for offence under Section 376 IPC read with Section 6 POCSO Act as well as proceedings arising out of the same are quashed. Pending application stands disposed of.
