JUDGMENT
1. The accused/applicant, in jail since 15.12.2021, seeks regular bail in case FIR No. 412/2021 of PS Vasant Kunj North for offence under Section 302/482/201/120B/34 IPC & 27 Arms Act.
2. Learned APP assisted by IO/Inspector Kishore Kumar accepts notice and after discussing with the IO submits that State has no serious objection in view of circumstances of this case.
3. Broadly speaking, the case set up by prosecution is based on circumstantial evidence and complicity of the accused/applicant was alleged BAIL APPLN. 3279/2025 pages on the basis of statement of one Mohd. Kasir Alam, who identified the accused/applicant in the photo gallery of mobile phone of the hotel manager. The said Mohd. Kasir Alam was projected by prosecution as eye witness, but he did not support prosecution case during trial. That is the reason, according to learned APP that she has opted not to oppose this bail application.
4. The status report dated 23.07.2025, which was filed before the Court of Sessions at the time of hearing bail application, reflects involvement of the accused/applicant in six more cases. All those cases were registered in Bihar and learned counsel for accused/applicant submits that in all those cases the local police of Bihar filed closure reports.
5. Considering the above circumstances, the bail application is allowed and the accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the learned trial court. Copy of this order be sent to the concerned Jail Superintendent for being immediately conveyed to the accused/applicant. Pending application also stands disposed of.
