SUSHIL @ LALLA .....Petitioner
Through: Mr. Sandeep Mishra, Advocate
Through: Mr. Nawal Kishore Jha, APP for State
Mr. Manoj Kumar, Advocate for R-2
JUDGMENT
1. Petitioner seeks quashing of case FIR No. 103/2018 of PS Bindapur for offence under Section 354/354A/354B/323/34 IPC on the ground that the complainant de facto (respondent no.2) has compromised the disputes with the petitioner.
2. Respondent no.2 present with her counsel and identified by IO/SI Gayatri accepts notice. Learned APP accepts notice and submits that State has no serious objection to this petition. CRL.M.C.6168/2025 pages
3. Keeping in mind the nature of allegations, I spoke with the parties in Hindi. It is submitted by them that respondent no.2, who was a tenant under the petitioner has now vacated the tenanted premises and they have resolved all their disputes amicably with the intervention of common family friends. Respondent no.2 submits that towards full and final settlement, the petitioner had to pay her Rs. 18,000/-, out of which Rs. 6,000/- has already been paid and the balance Rs. 12,000/- in cash has been paid today itself. Respondent no.2 specifically states that she does not wish to pursue the prosecution of the petitioner.
4. Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push them through trial.
5. Therefore, the petition is allowed and accordingly FIR No. 103/2018 of PS Bindapur for offence under Section 354/354A/354B/323/34 IPC as well as proceedings arising out of the same are quashed.
