Through: Mr. Raghav Mehdiratta and Mr. Saksham, Advocates.
Through: Mr. Nawal Kishore Jha, APP for State
JUDGMENT
1. Petitioners seek quashing of case FIR No. 527/2016 of PS Khyala for offence under Section 498A/406/34 IPC on the ground that the complainant de facto (respondent no.2) has compromised the disputes with the petitioners.
2. Respondent no.2, identified by IO/SI Vinay Sangwan is present in court. Detailed statements of parties have already been recorded by the concerned Joint Registrar. State has no serious objection to this petition.
3. I have spoken with respondent no.2 in Hindi. It is stated by her that all CRL.M.C.5108/2025 pages her disputes with the petitioners stand resolved amicably and she has received complete full and final settlement amount in lieu of her stridhan and alimony. It is stated by her that marriage between her and petitioner no.1 stands dissolved by decree of divorce and no child was born out of their wedlock. Respondent no.2 submits that she does not wish to pursue prosecution of petitioners.
4. Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push them through trial.
5. Therefore, the petition is allowed and accordingly, FIR No. 527/2016 of PS Khyala for offence under Section 498A/406/34 IPC as well as proceedings arising out of the same are quashed. Pending application stands disposed of.
