JUDGMENT
1. For the reasons mentioned therein, the delay of 70 days in re-filing is condoned. The application stands disposed of. CRL.M.C. 5845/2025
2. Petitioners seek quashing of case FIR No. 03/2024 of PS CAW Cell, Nanak Pura for offence under Section 498A/406/34 IPC on the ground that CRL.M.C. 5845/2025 pages the complainant de facto (respondent no.2) has compromised the disputes with the petitioners.
3. Respondent no. 2 present in Court and identified by IO/ASI Rajesh Malik accepts notice. Learned APP accepts notice and submits that State has no serious objection to this petition.
4. I have spoken with the parties in Hindi. It is stated by respondent NO. 2 and petitioner no. 1 that they have now resolved all matrimonial disputes between them. It is also submitted by them that now they are living together happily with their three year old daughter. Respondent no. 2 categorically states that now she has no complaint as regards her maintenance and household expenses. Respondent no. 2 also submits that she does not wish to pursue prosecution of petitioners.
5. Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push the parties through trial. Therefore, the petition is allowed and FIR No. 03/2024 of PS CAW Cell, Nanak Pura for offence under Section 498A/406/34 IPC as well as proceedings arising out of the same are quashed. Pending application stands disposed of.
