HIGH COURT OF DELHI
Date of Decision: 26th , August, 2025
CM(M) 1615/2025 & CM APPL. 52999/2025
RAM MULAKH DARBAR .....Petitioner
Through: Dr. M.K. Gahlaut, Advocate.
VERSUS
GOVT OF NCT OF DELHI .....Respondent
Through: Mr. Abhinav Singh, Advocate.
CORAM:
HON'BLE MR. JUSTICE MANOJ JAIN
JUDGMENT
(oral)

1. Petitioner is plaintiff before the learned Trial Court and has filed a suit for declaration, injunction, rendition of accounts etc.

2. The limited request in the present petition is to the effect that the learned Trial Court be requested to dispose of the suit in a time-bound manner.

3. The suit has been instituted in the year 2014 and, therefore, it is already a decade old suit.

4. There is, generally, a direction to learned Civil Courts to fast-track old cases and the suit in question being more than 10 years old is, even otherwise, required to be fast-track and dealt within an expeditious manner.

5. The important aspect is, however, that the issues have yet not been framed.

6. In the present petition, GNCTD has been made sole respondent and when asked, learned counsel for petitioner, in all fairness, admitted that CM(M) 1615/2025 2 GNCTD is not a party to the suit in question.

7. The present petition is, therefore, totally misconceived as the concerned defendants have not been made party to the present petition.

8. The matter, therefore, does not warrant any intervention. Nonetheless, since the case is already 10 year old, learned Trial Court would ensure that it is taken up with utmost expediency and is disposed of, as quickly as possible.

9. The present petition is disposed of in aforesaid terms.

10. Pending application also stands disposed of in aforesaid terms.
