1. After hearing arguments for some time, learned counsel for petitioner submits that he restricts his request only to grant of one opportunity to cross-examine PW-1/Mr. Sumit Kumar. He submits that since the defendants were contemplating challenging several orders, and since the counsel for the defendant No.1 was also not well, the cross-examination could not take place.

2. Learned counsel for respondent/plaintiff appears on advance notice and submits that though the defendants do not deserve any further opportunity, he, however, on instructions and, without prejudice to its rights and contentions, would have no objection, if one last and final opportunity is granted to the petitioner/defendant in this regard, albeit, subject to imposition of heavy cost.

3. The next date before learned Trial Court is stated to be 01.09.2025 for defendants’ evidence. CM(M) 1668/2025 2

4. In view of abovesaid, the present petition is disposed of with direction that petitioner herein would be permitted to cross-examine PW-1 on 01.09.2025. This would, however, be subject to availability of PW-1 on that day.

5. For causing delay in the matter, cost of Rs.25,000/- is imposed on petitioner/defendant No.1, to be paid to respondent/plaintiff before learned Trial Court on the next date i.e. 01.09.2025.

6. Petition stands disposed of in aforesaid terms.

7. Pending applications also stand disposed of in aforesaid terms.
