JUDGMENT
1. There is no appearance on behalf of the respondents. No reply to the transfer petition has been filed by the respondents.
2. I have heard learned counsel for the petitioner. The petitioner seeks transfer of Civil Suit No.177/2016 titled Sadhna Chathli vs. Poonam Gaur & Anr. from the court of Ms. Shuchi Laler, learned Additional District Judge, East District, Karkardooma Courts, Delhi, to the court of competent jurisdiction in Shahdara District, 2019:DHC:18 Tr.P.(C) No.142/2018 Karkardooma, Delhi, on the ground that the suit property is situated within the territorial jurisdiction of Shahdara District, Delhi.
3. The petitioner has placed on record a copy of the order dated 05.04.2018 passed by the court of learned Additional District Judge, East District, Karkardooma Courts, Delhi, observing that the suit property is situated within the territorial jurisdiction of Shahdara District.
4. In the circumstances, the Civil Suit No.177/2016 titled Sadhna Chathli vs. Poonam Gaur & Anr. is withdrawn from the court of Ms.Shuchi Laler, learned Additional District Judge, East District, Karkardooma Courts, Delhi, and is transferred to the court of learned District Judge, Shahdara District, Delhi, who is requested to either retain the matter or assign the same to any competent court under his jurisdiction. The petition is disposed of accordingly.
