Respondent No.2
JUDGMENT
1. Petitioners seek quashing of case FIR No. 592/2023 of PS Mundka for offence under Section 498A/406/34 IPC on the ground that the complainant de facto (respondent no.2) has compromised the disputes with the petitioners.
2. Respondent no.2 identified by IO/SI Krishan Kumar is present in court. Detailed statements of parties have already been recorded by the concerned Joint Registrar. State has no serious objection to this petition. st=Delhi, CRL.M.C.5075/2025 pages
3. I have spoken with the parties in Hindi and it is stated by them that they have resolved all matrimonial disputes amicably. Respondent no.2 specifically submitted that she has received the full and final settlement amount in lieu of her stridhan and alimony. Marriage between the parties already stands dissolved by decree of divorce and no child was born out of the wedlock. Respondent no.2 also states she does not wish to pursue prosecution of the petitioners.
4. Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push them through trial.
5. Therefore, the petition is allowed and accordingly FIR No. 592/2023 of PS Mundka for offence under Section 498A/406/34 IPC as well as proceedings arising out of the same are quashed.
