29.01.2019 After some hearing, the learned counsel for the petitioner fairl)' concedes that the impugned order passed by the first appellate court on
19.01.2019 falls within thejudicial discretion vested in the said court under
Section 389 Cr.P.C., as indeed being in sync with the letter and spirit of
Section 148 of Negotiable Instruments Act, 1881, and consequently submitted that he does notpress for any reliefin the nature ofwaiver ofsuch deposit as has been directed by the first appellate court. The counsel,atthe same time,submitted he may be permitted to withdraw the present petitions and given liberty to approach the first appellate court for enlargement of time for compliance with the directions aboutdeposit.
