JUDGMENT

1. It is submitted by Ms. Shalini Kapoor, the learned counsel for the petitioners and Mr. Devmalya Banerjee, the learned counsel for Respondent nos. 1, 3 to 5 and Mr. Subhodh Kumar Pathak, the learned counsel for the respondent no.2 that the parties have amicably resolved and settled their disputes by which the respondents have agreed to make the payment of Rs. 60 lakhs to the petitioners.

2. The learned counsel for the petitioners states that they have already received Rs. 30 lakhs from respondent nos. 1,[3] to

Today, the learned counsel for respondent nos. 1,[3] to 5 handed over to the learned counsel for the petitioners, three Demand Drafts, being No. 059798 and 059800 dated 06.03.2019 of Rs. 2 lakhs each and No. 059799 dated 06.03.2019 of Rs. 7 lakhs issued by Kotak Mahindra Bank, 0661-Mumbai-NPD Branch. The learned counsel for respondent nos. 1,[3] to 5 also handed over five cheques, Nos. 004488, 004486, 004489 dated 04.03.3019 for Rs. 5 lakhs each and Cheque Nos. 004487 and 004485 dated 04.03.2019 of Rs. 2 lakhs each drawn on DCB Bank, Andheri-West (004) Branch, Mumbai-400058 to the learned counsel for the petitioner.

3. Mr. Subhodh Kumar Pathak, learned counsel for respondent no.2, on instructions, undertakes that they will vacate the property in question and hand over its peaceful vacant possession to the petitioners within four days.

4. Admittedly, now nothing survives in the petition. The respondents shall ensure that Cheques are honoured on presentation and possession of the property in question is delivered as undertaken.
