29.04.2019 By these petitions, petitioners have prayed for quashing of the
2019:DHC:7540 r following cross FIRs:- (a) FIR No. 180/2016 under Sections 452/323/506/34 IPG registered at
P.S. Mansarovar Park(North East on the complaint ofMr.Rajender Kumar
Sharma,respondent no.2in Crl. M.C.No.2274/2019 and petitioner no. 1 in
Crl. M.C.no.2278/2019.
(b) FIR No. 181/2016 under Sections 452/323/506/34 IPG registered at
P.S. Mansarovar Park (North East on the complaint of Mr. Subhash, respondent no. 2 in Grl. M.G. No. 2278/2019 and petitioner no. 1 in Grl.
M.G.no.2274/2019.
It is submitted that petitioners and private respondents are neighbour.
A quarrel took place between them on some trivial issues, which led to registration of the aforesaid cross FIRs. Now, petitioners/private respondents, namely, Subhash, Vishal @ Bubble, Yogesh, Lalit, Rajender
Kumar Sharma, Bhaskar Sharma, Gopal Singh and Lalit Sharma have settled their disputes amicably before the Delhi Mediation Gentre, Karkardooma Gourts,Delhi on 19"^ January,2019,inasmuch asthey wantto maintain harmonious relation in future. Gomplainants/injured in both the
FIRs are not willing to pursue their respective FIRs. They are present in
Gourt and have been identified by SI Naresh Kumar of police station
Mansarovar Park.
Keeping in mind the fact that a quarrel ensued between the neighbours on some trivial matter, wherein a compromise has been entered into between them,in my view,no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest ofjustice both the FIRs, that is, aforesaid cross FIRs and consequent proceedings emanating therefrom are quashed.
Both the petitions are disposed ofin the above terms. Miscellaneous applications are disposed ofinffuctuous.
