"08.05.2019 On 08.02.2019, the petitioner was given interim protection with the observations and order, as under : , "The petitioners seek anticipatory bail. They are accused in case FIR No. 0097/18 dated 29.03.2018 registered under sections 376/452/323/328/506/120B Indian Penal Code, 1860 and section 4 ofProtection of Children from Sexual Offences
Act, 2012 at Police Station, R.K. Puram, Delhifor abetting the main accused in committing an offence under section 376IPC.
2019:DHC:7359 / The petitioners are.said to reside three kilometres awayfrom the main accusedandare notrelated to him;two otherpersms accused in the same case have been enlarged on bail. The petitioners have no criminal antecedents arid are parents oj minor children, whom they have to take care of.
In view of the above, the petitioners are directed to join investigations. Theyshallreportto theInvestigating Officer on
09.02.2019 at 3.00 pm and on all such dates as may be intimated by theInvestigating Officer.
Till the next date of hearing, the petitioners shall not be arrested.''"' ^ '
Now, supplementary challan is said to have been filed inter alia against the petitioner. Mr. Srivastava, on instructions, submits that the statement of the prosecutrix under- Sec. 164 Cr.P.C. was recorded on
31.03.2018 andforms partofthe challan earlier filed and that,no recovery ofany nature isto beeffectedfromthe petitioner.
Keepingin view thetotality ofthefacts arid circumstances,the order dated08.02.2019is extendedforfour weeksfromtoday,during whichtime, thepetitionershallapproachthetrialcourtforseekingregularbail.
Petition stands disposed offaccordingly.
