JUDGMENT

1. Learned Counsel for the parties submit that an offer was made by the Respondent to the Petitioner, which offer has been accepted, and that the parties have amicably resolved their disputes. 1.[1] Learned Counsel for the parties further submit that the Petitioner has agreed to make payment in the sum of Rs.2,75,000/- to the Respondent in full and final settlement for all his claims in the matter.

2. Learned Counsel for the Petitioner submits that for this purpose, the amounts that have been deposited with the Registry of this Court may be released to the Respondent.

3. Learned Counsel for the parties submit that Rs. 2,50,000/- was deposited with the Registry of this Court. However, since the deposit has been there for more than five years, the amounts should be in excess of Rs.2,75,000/- lakhs today.

4. Learned Counsel for the Petitioner submits that, in terms of the W.P.(C) 42072020 settlement, Rs.2,75,000/- be paid to the Respondent and the balance amount lying with the Registry of the Court be released in favour of the Petitioner.

5. Accordingly, and in view of the settlement arrived at between the parties, the following directions are passed:

(i) The Respondent shall be permitted to withdraw Rs.2,75,000/- from the Registry of this Court, which is the amount deposited inclusive of interest.

(ii) Once this amount has been taken by the Respondent, the balance amounts which will remain with the Registry, shall be released in favour of the Petitioner.

6. Learned Counsel for the Respondent, on instructions, submits that Respondent is accepting this amount in final settlement of his dues and that the Respondent shall have no further claim against the Petitioner. 6.[1] The statement of learned Counsel for the Respondent is taken on record. The Respondent is bound down by the statement made by his Counsel today.

7. The Petition is disposed of in the aforegoing terms. The pending Application stands closed.
