1. Petitioner seeks interim bail in FIR No.486/2013 under Sections 307/34 IPC, Police Station Tilak Nagar on the ground of illness of his wife. Subsequently, Sections 302/201/120B/34 IPC and Sections 25/27/54/59 Arms Act have been added.
2. Learned counsel for the petitioner submits that the wife of the petitioner has to undergo surgery and is admitted in Shakuntala Hospital. He submits that the surgery is to take place on 09.08.2019. 2019:DHC:3812
3. Learned counsel for the petitioner submits that earlier also the petitioner was enlarged on interim bail by the Trial Court by order dated 14.01.2019 and he did not misuse his liberty and surrendered within time.
4. Status report/Reply to the bail application has been filed. The same is taken on record. Medical condition of the wife of the petitioner has been verified.
5. Learned APP for the State submits that the petitioner is also in custody in FIR No.3/2012 under Section 216/120B and Sections 10/13 Unlawful Activities Act, Police Station Kotwali, Ranchi.
6. Without commenting on the merits of the case and keeping in view the totality of facts and circumstances of the case, it is directed that on petitioner furnishing a bail bond in the sum of Rs.50,000/with one surety of the like amount to the satisfaction of the Trial Court, petitioner is granted interim bail for a period of 3 weeks from the date of his release in this FIR.
7. Petitioner shall not leave the NCT of Delhi without prior permission of the Trial Court. Petitioner shall mark his presence with the IO/SHO/Duty Officer concerned of Police Station Tilak Nagar at 10 am of every alternative day.
8. It is further clarified that this order is subject to petitioner obtaining an appropriate order, of bail/interim bail, from the concerned Court in FIR No.3/2012, Police Station Kotwali, Ranchi.
9. Petitioner shall surrender to the concerned Superintendent, Jail on the expiry of the period of 3 weeks from the date of his release.
10. Petition is, accordingly, disposed of.
