13.08.2019 Counsel for the petitioner submits that the petitioner has settled the matter with complainant/respondent No.2, Mr. Saurabh Mittal and he has paid the cheque amount and the settled amount. Counsel for the petitioner
2019:DHC:7763 further submits that since the parties have settled the matter, the present review petitions be allowed and the offence be compounded.
The respondent No.2, Mr. Saurabh Mittal is present in Court today, represented through his Counsel Mr. Sanjay Sharma, who has filed his vakalatnama today. Counsel for respondent No.2 on instructions submits that the matter has been entered into an oral settlement between the parties and the respondent No.2 has received Rs.2,30,000/- including the compensation amount vide DD Nos. 009134 (Rs. 1,90,000/-) and 009124
(Rs.40,000/-). He further submits that respondent No.2 has no objection if the present petition is allowed and the offence is compounded.
In view of the submissions made by counsel for the parties, I compound the offence and consequently set aside the order on sentence dated 29.03.2019 passed by learned ACMM, NE, Karkardooma Courts, Delhi and the order dated 30.07.2019 passed by learned ASJ, NE, Karkardooma Courts,Delhi.
It is directed thatthe revisionist/petitioner be released forthwith.
The review petitions are disposed ofaccordingly.
A copy ofthis order be sent to the concerned Jail Superintendent for necessary compliance.
Copy ofthis order be sentto the trial Courtfor information.
As prayed, copy of this order be given dasti under the signatures of
