1. By these two petitions, the petitioners individually sought parole. Petitioner Anil Kumar had sought parole on the ground that his wife has been diagnosed to be suffering from disc prolapsed on account ofa fall and has been advised complete bed rest and physiotherapy. Petitioner Rahish@ Ganja also sought parole on the ground that his wife is unwell and has to undergo surgery which was scheduled on lO^'^ June,2019. In support of the fact that his wife was to undergo surgery, a certificate was annexed as Annexure B from one Chaudhry Ramdhan Lakra Memorial Hospital, Hiran Kudna, Delhi signed by Dr. Dharam Chand Lakra, MBBS, MD (Medicine), Medical Superintendent CRLM Hospital, Hiran Kudna, Delhi. The medical certificate advised surgical operation by orthopaedic surgeon on 10^'^ June,2019 at 11.00 AM sharply.

Considering the nature of documents, this Court directed a thorough inquiry when it was revealed that the address mentioned in the medical certificate was the residence of Dr. Dharam Chand Lakra where no facility of treatment/ hospital existed. This Court thus vide order dated 31'^ May, 2019 in W.P.(CRL) 1654/2019 directed DCP to file a detailed report after verification and in W.P.(CRL)1680/2019 issued Court notice to Dr.Dharam Chand Lakra.

A status report has been filed by the DCP concerned in W.P.(CRL) 1654/2019 indicating that Dr. Dharam Chand Lakra was neither enrolled/ registered with the Medical Council of India nor with the Delhi Medical Council. Whether Dr. Dharam Chand Lakra has completed his MBBS,MD as claimed from Maulana Azad Medical College,Delhi is yet to be verified. However, it is clear that in the absence of enrolment he could not have practised and much less given eertifieates to the people advising surgeries and fixing the dates thereof facilitating people in getting paroles/ bails on fake documents. 5. Since despite notice Dharam Cliand Lakra was not appearing, this Court issued bailable waiTants against Dr. Dharam Chand Lakra pursuant to which he is present in Court today. He insists that he has completed his MBBS,MD degrees from Maulana Azad Medieal College.

6. The facts thus need to be investigated properly. However,prima facie in view ofthe fact that without any proper hospital being there Dr. Dharam Chand Lakra was advising and fixing patients for surgery, prima facie fake medieal doeuments have been issued by him.

7. Consequently, SHO PS Mundka is directed to register FIR and investigate the same thoroughly under proper supervision of the DC? concerned.

8. Since the two medical certificates have not been found genuine, this Courtfinds no ground to grant parole to the two petitioners.

9. Writ petitions are accordingly disposed ofwith directions to the DCP concerned to submit a report after registration of FIR and investigation thereofwithin eight[8] weeks.

10. Renotifyfor compliance on 5^*^ November,2019.
