National Pharmaceutical Pricing Authority and Anr. v. Garima Seth & Ors.

1. This is an application seeking correction of a typographical error in the judgment and order dated 14.08.2019. It is submitted that in para 1 of the order, the number of the subject O.A. has been mentioned as 153/2002 whereas the number of the said O.A. was 156/2002 A perusal of the record shows that the Petitioner had impugned order dated 28.01.2003 passed by the Tribunal in O.A. No.156/2002.

2. Accordingly, the typographical error is corrected in para 1 of the judgment and order dated 14.08.2019. Correct O.A. No.156/2002 shall be read in place of O.A. No.153/2002.

3. Application is disposed of, in above terms. W.P.(C) 6441/2003 2022:DHC:5891-DB

4. This order shall be uploaded as a Corrigendum to the judgment and order dated 14.08.2019. CM No.9934/2020 (condonation of delay of 100 days in filing the application)

5. This is an application seeking condonation of delay of 100 days in filing the application, being CM No.9933/2020. The said application has been premised on the ground of a typographical error that has crept in order and judgment dated 14.08.2019.

6. There is no period of limitation prescribed under Section 152 CPC.

7. Consequently, the application seeking correction is within time. Application is accordingly disposed of.
