On a query being put to the learned counsel for the petitioner that the remedy would lie before the National Green Tribunal(NOT), he relies upon the interim order dated 31.07.2019 passed by this Court in a batch of petitions including W.P.(C)8278/2019, wherein on similar petitions, notice has been issued to the respondents and interim protection granted in favour ofthe petitioners therein.
As the order relied upon is only an interim order that does not reflect any objection having been taken by the respondents on the maintainability ofthe petitions,the order cannot be read as conferring jurisdiction to this Court while ousting thejurisdiction ofthe NOT.
Confronted with the objection, the learned counsel for the petitioner prays for leave to withdraw these present petitions with
2019:DHC:7912 iC liberty to take appropriatelegalremedy before the NGT.
Accordingly, the petitions are dismissed as withdrawn with liberty as prayed for.
