For the reasons stated in the application, delay is condoned.
Application stands allowed and disposed of accordingly.
Vide the present petition, the petitioners seek quashing of FIR No.
671/2014 dated 01.11.2014, registered at Police Station- Ashok Vihar for
2019:DHC:4302 the offences punishable under Sections 498A/406 of the IPC and consequent proceedings arising therefrom.
Notice issued.
Notice is accepted by learned APP for the State and counsel for the respondent no.2.
With the consent of the counsel for the parties, the present petition is taken up for final disposal.
The petitioner no.1 and respondent no.2 got married on 14.11.2010 as per Hindu rites and ceremonies.
The present petition is filed on the ground that the parties have settled their disputes and the respondent No. 2 has no objection if the present petition is allowed.
Respondent No. 2 is personally present in Court with learned counsel
– Mr. Vivek Gupta, Advocate and she has been identified by SI Sandeep
Kr., SOS-I, Crime Branch/IO.
The petitioners and respondent no.2 have entered into an amicable settlement vide settlement deed dated 17.07.2018. The total settlement amount is Rs.41,25,000/-, out of Rs.31,25,000/- has been received by the respondent No. 2 and for the balance amount of Rs.10 lakhs, a demand draft bearing No. 503509 dated 07.05.2019, revalidated on 08.08.2019, is handed over to the respondent No. 2 today in the Court.
Taking into account the aforesaid facts, this Court is inclined to quash the concerned FIR as no useful purpose would be served in prosecuting the petitioners any further.
For the reasons afore-recorded, the FIR No. 671/2014 dated
01.11.2014, registered at Police Station- Ashok Vihar for the offences punishable under Sections 498A/406 of the IPC and consequent proceedings arising therefrom are quashed.
The petition is allowed accordingly.
Copy of this order be given dasti under the signatures of Court
Master.
