JUDGMENT

1. Mr. Kapil Midha, learned Counsel for the appellant, after some hearing, seeks leave to withdraw the appeal.

2. The appeal is, accordingly, dismissed as withdrawn and the order of the learned Single Judge is upheld.

3. He further submits that there are certain goods which are lying seized with respect to which IA 42795/2024 had already been filed, seeking their release, which also stands dismissed by the impugned order. FAO(OS) (COMM) 57/2025

4. He seeks leave to move a fresh application before the learned Single Judge with permission to remove the said goods after modifying them in a manner which would be to the satisfaction of the learned Single Judge. He categorically undertakes that the appellant would remove, from the said goods, the word ‘INDEED’.

5. We reserve liberty with the appellant to move an appropriate application before the learned Single Judge to the said effect. If and when, such an application is moved, it would be considered and disposed of on its own merits.
