JUDGMENT
(ORAL)

1. Respondent No.1 is present in Court along with his counsel and submits that the draft of Rs.3,06,640/- is ready and shall be deposited with the Registrar General of this Court within three days.

2. Learned senior counsel for respondent No.1 submits that respondent No.1 is willing to gracefully pay the interest at the statutory rate of 12% per annum as well as 50% of the penalty amount.

3. As per the calculation of the Accounts Officer of this Court, a sum of Rs.1,12,044/- is payable towards the interest and a sum of Rs.4,05,820/- is payable towards penalty. Let the same be deposited by respondent No.1 with the Registrar General of this Court within three weeks.

4. The petition is disposed of in the above terms. Pending applications 2019:DHC:4401 W.P.(C) 11436/2018 are also disposed of.

5. List for disbursement of the amount on 18th October, 2019.

6. Petitioner No.1 shall remain present in Court on the next date of hearing along with passbook of her savings bank account near the place of her residence.

7. The petitioner No.1’s Bank is directed not to issue any cheque book or debit card to the petitioner No.1 and if the same have already been issued, the bank is directed to cancel the same and make an endorsement on their passbook to this effect. Petitioner No.1 shall produce the copy of this order to the concerned bank, whereupon the bank shall make an endorsement on the passbook of petitioner No.1 that no cheque book and/or debit card shall be issued to petitioner No.1 without the permission of this Court.

8. Petitioner No.1 shall produce the passbook of her savings bank account with the endorsement, PAN card and Aadhaar card as well as PAN card and Aadhaar card of petitioner No.2 to 4.

9. This Court appreciates the assistance rendered by learned counsels for the parties.
