JUDGMENT
1. Exemption allowed, subject to all just exceptions.
2. The application stands disposed of. This is a petition under Section 29A of the Arbitration & Conciliation Act, 1996, seeking extension of time for completion of the arbitral proceedings and passing of the award. 2019:DHC:4420 Disputes and differences arose between the parties and the Arbitration Clause was invoked. On 9.8.2017, the learned Arbitrator entered upon reference and initiated the arbitration proceedings. The statutory period of twelve months for completion of proceedings and passing of the award having expired, the parties, by mutual consent, extended the mandate of the Tribunal by a period of six months. The extended time period expired on 9.2.2019. The petitioner moved this Court by filing an OMP (Misc.)(Comm.) 62/2019 and vide order dated 15.02.2019, the time was extended by a period of six months with effect from 9.2.2019. The extended time has expired on 8.8.2019. It submitted by learned counsels for the parties that the proceedings are at the stage of the cross examination of the witness of the respondent and thus seek extension of time to complete the proceedings. For the reasons stated in the petition, the same is allowed. The time for completion of the arbitral proceedings and passing of the award is extended by a period of ten months from 9.8.2019. The petition is disposed of in the above terms.
