JUDGMENT

1. This is an Application filed on behalf of the Petitioner seeking condonation of delay of 43 days in filing the present Petition.

2. For the reasons as stated in the Application, the delay is condoned.

4. Allowed, subject to just exceptions.

6. The present Petition has been filed under Section 115 of the Code of Civil Procedure, 1908 [hereinafter referred to as “CPC”] impugning the order dated 14.05.2025 passed by the learned Trial Court [hereinafter referred to as “Impugned Order”]. By the Impugned Order, first Application under Section 11 and under Order XII Rule 6 of the CPC read with Section 151 of the CPC filed by the Respondents and the Application under Order C.R.P. 276/2025 XXXIX Rule 1 and 2 and the Application under Order I Rule 10 of the CPC filed by the Petitioner have been decided.

7. After some arguments, learned Counsel for the Petitioner seeks and is granted permission of the Court to withdraw the present Petition with liberty to file an appropriate Petition in accordance with law.

8. Accordingly, the Petition is dismissed as withdrawn with liberty as prayed for.
