JUDGMENT

1. Petitioner impugns order dated 10.05.2019, whereby, leave to defend application of the petitioner has been dismissed and an eviction order passed.
2. Respondent had filed the subject eviction petition seeking eviction of the petitioner, on the ground of bonafide necessity under Section 14(1) (e) and 14D of the Delhi Rent Control Act, 1958, from 2019:DHC:4894 RC.REV. 534/2019 Property No.17/44, Part of Khasra No.275, Zakhir Nagar, Okhla, New Delhi-110025.
3. Learned counsel for the petitioner, under instructions, seeks leave to withdraw the petition.
4. Petitioner, who is present in Court in person, undertakes that petitioner shall vacate and handover the peaceful vacant possession of the tenanted premises on or before 31.10.2019. He further undertakes that he shall clear all water, electricity and other charges in respect of the tenanted premises before he vacates the premises. He further undertakes that he shall not sublet, assign or part with the possession of the tenanted premises or any part thereof.
5. The undertaking is accepted.
6. The Petition is dismissed as withdrawn.
7. On petitioner filing an affidavit of undertaking, within one week in the above terms, execution of the impugned order shall remain stayed till 31.10.2019.
8. Order Dasti under signatures of the Court Master.
