1. Petitioner impugns order dated 03.10.2018, whereby, leave to defend application of the petitioner has been dismissed and an eviction order passed.

2. Respondent had filed the subject eviction petition seeking eviction of the petitioner on the ground of bonafide necessity under Section 14(1) (e) of the Delhi Rent Control Act, 1958, from shop at ground floor forming part of property No.1468, Gali No.24, Naiwala, Karol Bagh, New Delhi-110005, more particularly shown in red colour in the site plan annexed with the petition. 2019:DHC:5006 RC.REV. 417/2019

3. Learned counsel for the petitioner submits that the possession of the subject premises was taken over by the respondent during execution proceedings.

4. Learned counsel for the petitioner submits that he has instructions from the petitioner to withdraw the petition. He seeks leave to withdraw the Petition.

5. The Petition is dismissed as withdrawn.

6. Order Dasti under signatures of the Court Master.
