JUDGMENT
1. Vide the present petition, the petitioners seek direction thereby quashing FIR No. 424 dated 26.11.2018, registered at PS Farsh Bazar and all other proceedings emanating therefrom.
2. Notice issued.
3. Notice is accepted by learned APP for the State and counsel for the respondent no.2.
4. With the consent of the counsel for the parties, the present petition is 2019:DHC:5128 taken up for final disposal.
5. The present petition is filed on the ground that the parties have settled their disputes and the respondent no.2 has no objection if the present petition is allowed.
6. Respondent No. 2 is personally present in Court with learned counsel and he has been identified by SI Kapil/IO and submits that matter has been settled and he does not wish to prosecute the matter any further.
7. The petitioners and respondent no.2 have entered into an amicable settlement vide settlement deed dated 03.06.2019.
8. The total settlement amount is ₹1,72,000/-(Rupees One Lakh Seventy Two Thousand only). It is submitted that the respondent no.2 has already received an amount of ₹27,000/- (Rupees Twenty Seven Thousand only) in cash. The demand draft bearing no.502373 dated 04.10.2019 for ₹49,000/- (Rupees Forty Nine Thousand Only), demand draft bearing no. 747823 dated 23.09.2019 for ₹49,000/- (Rupees Forty Nine Thousand Only) and demand draft bearing no.747825 dated 23.09.2019 for ₹47,000/- (Rupees Forty Seven Thousand Only) are handed over to the respondent no.2 today in the Court.
9. Taking into account the aforesaid facts, this Court is inclined to quash the concerned FIR as no useful purpose would be served in prosecuting the petitioners any further.
10. For the reasons afore-recorded, the FIR No. 424 dated 26.11.2018, registered at PS Farsh Bazar and consequent proceedings emanating therefrom are quashed.
11. The petition is allowed accordingly.
