JUDGMENT

1. By this application, petitioners seek correction of judgment dated 01.10.2019 whereby on account of a typographical error, in paragraph No. 46, the date of the impugned order has been noticed as 21.07.2016 instead of 12.03.2019, even though in paragraph 1 of the order the correct date of the impugned order i.e. 12.03.2019 has been mentioned.

2. In view of the above, the application is allowed. The typographical error in paragraph No. 46 of the judgment dated 01.10.2019 is corrected. The date i.e. 21.07.2016 mentioned in paragraph No. 46 shall read as 12.03.2019.

3. The paragraph No. 46 after correction shall read as under: - 2019:DHC:6752 RC.REV. 385/2019 Page 2

“46. In view of the above, the impugned order dated 12.03.2019 is unsustainable and is set aside. The leave to defend application of the Respondent is dismissed. Decree of eviction is passed in respect of shop No. 1, H- 4, Ground Floor, Main Market, Rajouri Garden, New Delhi-110027 more particularly as shown in red colour in the site plan annexed with the eviction petition. In terms of Section 14(7) of the Delhi Rent Control Act, the order shall not be executable for a period of six months.”

4. The application is disposed of in the above terms.

5. Registry is directed to upload this order as corrigendum to judgment dated 01.10.2019.
