JUDGMENT
1. Allowed, subject to all just exceptions.
2. Application is disposed of.
3. Vide the present petition, the petitioner seeks direction thereby quashing FIR No. 440/2015 dated 23.06.2015, registered at PS AnandVihar and all other proceedings emanating therefrom.
4. Notice issued. 2019:DHC:5507
5. Notice is accepted by learned APP for the State and counsel for the respondent no.2 and with the consent of the counsel for the parties, the present petition is taken up for final disposal.
6. The present petition is filed on the ground that the parties have settled their disputes and the respondent no.2 has no objection if the present petition is allowed.
7. Respondent no.2/injured is personally present in Court with learned counsel and submits that the matter has been settled and he has been identified by SI J.P. Sharma/IO and he does not wish to prosecute the matter any further.
8. The total settlement amount is Rs.55,000/- (Rupees Fifty Five Thousand Only). It is submitted that the respondent nos.2&3 already received an amount of Rs.30,000/- (Rupees Thirty Thousand only). The balance amount of Rs.25,000/- has been paid in cash to respondent no.2.
9. The petitioner and respondent nos.[2] &3 have entered into an amicable settlement before the Court of Ld. ACMM/(Shahdara)/Karkardooma/Delhi on 18.09.2019.
10. Taking into account the aforesaid facts, this Court is inclined to quash the concerned FIR as no useful purpose would be served in prosecuting the petitioner any further.
11. For the reasons afore-recorded, the FIR No. 440/2015 dated 23.06.2015, registered at PS Anand Vihar and consequent proceedings emanating therefrom are quashed.
12. The petition is allowed accordingly.
